Use of the Website

1. Objective

The objective of these General Conditions is to stipulate the use of the website currently found at the URL www.dir.cat / www.dirfitness.cat / www.dir.es / www.dirfitness.es (hereafter the "Corporate Website") belonging to GESTORA CLUBS DIR SL (hereafter, "GDC"), without prejudice to any specific conditions which may apply to some services or contents within the Corporate Website.

2. Web Access and Use

Accessing and using the Corporate Website is free and does not require registering as a user. Nevertheless, access to and the use of certain information and services available on the Corporate Website may only be done after first registering as a user.

3. Use of Information

The intellectual property rights of the information, data, content, databases, designs, source code, navigational structure and other services and products included in the Corporate Website are the exclusive property of GCD. The user commits himself/herself to not violate any related industrial or intellectual property rights and is expressly prohibited from copying these in whole or in part, publicly communicating or distributing them or using them in any manner without GCD's express written permission. The user commits himself/herself to use the information and services exclusively for his/her own purposes and to not carry out any direct or indirect commercial use of the services he/she has access to by using the Corporate Website without GCD's express written permission. The user may not use any Corporate Website feature or capacity to carry out or suggest activities which are prohibited by law or to attempt to attract users to other competing services.

4. Corporate Website Functioning

GCD may make any modification to the Corporate Website it considers pertinent, including modifying any additional services or content than those currently available, or even eliminate these. GCD may change its Corporate Website whenever it deems appropriate and may block user access to a part or all of the Corporate Website to make any necessary change or repair at any given moment. In no case shall GCD be held responsible for the system's incorrect functioning if the latter is due to the incorrect configuration of the users' computer equipment or if said equipment does not have the capacity required to be able to use the service. GCD commits itself to carry out every effort possible to maintain the information and content on the Corporate Website up to date, though the user expressly understands that there may be incorrect elements within the contents and services detailed on the Corporate Website which, in this case, GCD will attempt to correct as soon as possible upon learning of their existence.

5. Ethical and Derived Responsibility from the User's Use of Internet and the Corporate Website

In no way shall GCD be held responsible for the user's use of the Corporate Website. The user will abstain from using the Corporate Website or the resources made available on the latter to violate any intellectual or industrial property rights belonging to GCD or third parties, and he/she will refrain from any activities which may violate the honour, personal or family privacy of any third party, the image of any third party and he/she will refrain from carrying out any acts which may be considered illicit or immoral and, in any case, will not hold GCD liable for any judicial or extra-judicial suit which may arise as a result of said use. The user will abstain from destroying, altering or disabling by any means any online programme or document belonging to GCD and he/she will abstain from introducing or transmitting any programme, virus, applet or any physical or electronic instrument which may cause or be liable to cause any type of alteration within Internet, the system or third-party computers. It is hereby expressly prohibited to erase or modify email messages belonging to others and to send bulk mailings with commercial or publicity-related ends, as well as carry out any activity or practice which violates the generally accepted principles of acceptable behaviour among Internet users.

6. Copyright

All the distinctive marks, such as brands, trade names, etc., which appear in the Corporate Website are protected by current legislation regarding brands. The users may not reproduce, communicate, exploit or use said brands and names without the prior written permission by their corresponding title-holders.

Confidentiality and Personal Data Protection

In accordance with Organic Law 15/1999, dated 13 December, on Personal Data Protection (LOPD in Spanish), you are hereby informed that we keep an automated file containing personal data about the users who introduce said data in the Corporate Website under the responsibility of GCD in order to carry out tasks related to informing, training and commercially promoting GCD services. Said file is registered with the Data Protection General Registry under registration code number 2031610073. You may exercise your rights to access, rectify, cancel or reject the processing of your personal data at any given time in accordance with the terms and conditions foreseen in the LOPD by writing to the following address: GCD SL, Industria 90-92 entlo-6, 08025 Barcelona. For your convenience, GCD also allows you the possibility of exercising said rights by writing to the following email address: [email protected]

The aim of said processing is to permit you to take part in the services available on the www.dir.cat website as well as to receive commercial information regarding Grupo DiR activities, products and services and those of third-party partners operating in the sports, entertainment, and the distribution of consumer goods and article industries, and you hereby consent to your data possibly being ceded to these.

Non-completion or partial completion of the personal data requested in any online form may imply that GCD will not be able to fulfil your request.

GCD is committed to fulfilling its obligations to protect personal data and to safe-keep them and it will adopt the necessary measures to prevent said data from being altered, lost, treated, misused, accessed without authorisation or stolen, given the current state of technology at all times.

Data Communication

The user expressly consents that he/she cedes his/her data contained within the automated file to the Grupo DiR companies detailed in the last section of these Conditions. The aim of said consent is to permit Grupo DiR to carry out tasks related to informing, training and commercially promoting its services in the sports industry area. You may revoke your consent regarding the communication of your data at any given time, though it cannot have retroactive effects. By the same token, the user consents to his/her data being communicated to those suppliers whose intervention is necessary in order to offer the service.

Cookies

You are hereby informed that GCD uses and installs cookies on your computer. Cookies are small text files which your browser stores on your computer's hard drive. When you visit a GCD webpage, the GCD server can recognise this cookie which provides information about your last visit.
